1. ACCEPTANCE OF TERMS

Welcome to Magellanister! These Terms of Service ("Terms") constitute a legally binding agreement between you and the service provider ("we," "us," "our") regarding your use of the Magellanister mobile application and website (collectively, the "Service"). In case of any discrepancies, the German version of these Terms shall take precedence.

1.1 Agreement Scope

By downloading, installing, accessing, or using our Service, you agree to be bound by these Terms. These Terms apply to:

  • The Magellanister mobile application (iOS and Android)
  • The website magellanister.netlify.app
  • All related services, features, and content
  • All updates and modifications to the Service

1.2 Eligibility

Age Requirements: You must be at least 13 years old to use our Service. If you are between 13 and 18 years old (or the age of majority in your jurisdiction), you may only use the Service with the consent of a parent or legal guardian.

EU/Germany Specific: In accordance with GDPR Article 8, users in the EU must be at least 16 years old or have parental consent.

2. SERVICE DESCRIPTION

2.1 Core Functionality

Magellanister is a German language learning platform that provides:

  • Interactive Stories: Audio-synchronized German stories across CEFR levels A1-C2
  • Multi-language Support: Content translated into 11 languages (English, French, Spanish, Turkish, Ukrainian, Chinese, Portuguese, Czech, Russian, Italian, Polish)
  • Vocabulary System: Personal dictionary with translations, examples, and notes
  • Audio Learning: Professional voice narration with speed control and word highlighting
  • Progress Tracking: Learning statistics, goals, and activity calendar
  • Quiz System: Interactive tests for comprehension assessment
  • Books Library: Extended reading materials for advanced learners

2.2 Content Structure

Our educational content is organized as follows:

  • Stories Collections: Thematically grouped stories for progressive learning
  • CEFR Levels: Content aligned with European Framework standards
  • Audio Synchronization: Sentence and word-level timing for enhanced comprehension
  • Grammar Integration: Contextual grammar explanations and word forms

2.3 Offline Features

The Service includes offline capabilities through intelligent caching (up to 700MB, 300 files). Cached content remains available for 60 days and is automatically managed to optimize device storage.

3. ACCOUNT AND REGISTRATION

3.1 Account Creation

No Registration Required: Our Service operates on a privacy-by-design principle. No account registration is required for basic functionality. All user data is stored locally on your device.

3.2 Premium Subscriptions

Premium subscriptions are managed through:

  • iOS: Apple App Store account and billing system
  • Android: Google Play Store account and billing system
  • RevenueCat Service: Third-party subscription management (see Privacy Policy)

Your Responsibilities: You are responsible for maintaining the security of your App Store/Google Play account and all activities under your subscription.

4. SUBSCRIPTION AND PAYMENT TERMS

4.1 Free Tier Limitations

Free Version Includes:

  • Daily Story Limit: 1 story per day, expandable to maximum 4 stories through rewarded video ads (max 3 ads per day)
  • Vocabulary Limit: Maximum 50 words in personal dictionary
  • Basic Features: Stories, audio, basic vocabulary, quizzes
  • Advertising: Rewarded video ads (personalized or non-personalized based on your region and consent)

4.2 Premium Benefits

Premium Subscription Includes:

  • Unlimited Stories: Access to all stories without daily limits
  • Unlimited Vocabulary: No restrictions on saved words
  • Books Library: Full access to extended reading materials
  • Activity Calendar: Visual progress tracking and goal setting
  • Voice Selection: Multiple voice options for audio narration
  • Personal Notes: Custom notes for vocabulary words
  • Ad-Free Experience: Complete removal of all advertisements
  • Priority Support: Enhanced customer service

4.3 Subscription Plans

Available Plans:

  • Monthly: Billed monthly with automatic renewal
  • Semi-Annual: Billed every 6 months with automatic renewal
  • Annual: Billed yearly with automatic renewal

Pricing: Current subscription prices are displayed in the app and vary by region. All prices include applicable taxes.

4.4 Billing and Automatic Renewal

Automatic Renewal: Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period. Renewal charges occur within 24 hours prior to the end of the current period.

Payment Processing: All payments are processed by Apple App Store or Google Play Store according to their respective terms and conditions.

4.5 Cancellation and Refunds

Cancellation: You may cancel your subscription at any time through your device's subscription settings:

  • iOS: Settings → Apple ID → Subscriptions
  • Android: Google Play Store → Account → Subscriptions

Access After Cancellation: Premium features remain available until the end of your current billing period. No refunds for partial periods.

Refund Policy: Refunds are subject to Apple App Store or Google Play Store policies and are handled directly by these platforms.

4.6 Promotional Codes

Validation: Promotional codes are validated through our secure API. Maximum 3 attempts per 24-hour period. Failed attempts result in 24-hour account suspension for promotional code validation.

Terms: Promotional subscriptions have specified expiration dates and cannot be combined with other offers.

5. ADVERTISING POLICY

5.1 Types of Advertising

Rewarded Video Ads Only: We exclusively use rewarded video advertisements through Google AdMob. These ads are:

  • Voluntary - displayed only when you actively choose to watch them
  • Rewarded - provide additional stories (maximum 3 ads per day)
  • Personalized or non-personalized - based on your region and consent preferences
  • Age-appropriate - comply with platform content guidelines

5.2 Advertising Personalization

Regional Compliance:

  • EU/UK & Regulated US States: Personalized ads and use of Advertising Identifiers require your explicit consent via iOS App Tracking Transparency (ATT) followed by Google's consent management platform. You can manage these preferences in Privacy Settings.
  • Other Regions: Personalized ads using Advertising Identifiers may be shown based on legitimate business interest unless you opt-out through device settings or Premium subscription.
  • Non-personalized Ads: Served when consent is withdrawn in regions where consent is required, or when users opt-out through device settings. These do not use Advertising Identifiers for targeting.

5.3 Advertising Limitations

Daily Limits:

  • Maximum 3 rewarded video ads per 24-hour period
  • Minimum 90-second interval between ad views
  • Counters reset at midnight local time

Premium Users: Subscribers have complete ad-free experience with no advertising of any kind.

5.4 Advertising Data Collection

Advertising Data and Identifiers: Ad services may collect and process:

  • Device Advertising Identifiers: IDFA (iOS) / Advertising ID (Android) - only when consent is provided in regulated regions
  • Basic device information: OS version, app version, device model
  • Ad interaction data: Views, clicks, completions - only when you voluntarily watch advertisements
  • Consent status and preferences: Stored locally and used to determine ad personalization

6. ACCEPTABLE USE POLICY

6.1 Permitted Use

You may use our Service for:

  • Personal German language learning and education
  • Accessing and interacting with provided educational content
  • Creating and managing your personal vocabulary
  • Tracking your learning progress and goals
  • Sharing your progress through built-in sharing features

6.2 Prohibited Activities

You agree NOT to:

  • Reverse Engineering: Decompile, disassemble, or attempt to derive source code
  • Content Extraction: Systematically download, copy, or redistribute our educational content
  • Account Manipulation: Create multiple accounts to circumvent limitations
  • Service Disruption: Interfere with servers, networks, or other users' access
  • Automated Access: Use bots, crawlers, or automated tools
  • Commercial Use: Use content for commercial purposes without permission
  • Fraudulent Activity: Attempt to manipulate billing, ads, or promotional systems
  • Malicious Code: Introduce viruses, malware, or harmful code

6.3 Enforcement

Violation of these terms may result in immediate termination of access without notice or refund. We reserve the right to investigate suspected violations and cooperate with law enforcement when necessary.

7. INTELLECTUAL PROPERTY RIGHTS

7.1 Our Intellectual Property

Protected Content: All content in the Service is protected by copyright, trademark, and other intellectual property laws, including:

  • Educational Stories: Original German text and translations
  • Audio Content: Professional voice recordings and timing data
  • Visual Content: Story illustrations, app icons, and interface design
  • Software: Application code, algorithms, and user interface
  • Branding: Magellanister name, logo, and trademarks
  • Methodology: Educational approach and content organization

7.2 License Grant to You

Limited License: We grant you a personal, non-exclusive, non-transferable, revocable license to use the Service solely for personal German language learning purposes, subject to these Terms.

Restrictions: This license does NOT permit you to:

  • Create derivative works or adaptations
  • Distribute or publicly display our content
  • Use content for commercial purposes
  • Remove copyright or proprietary notices
  • Transfer or sublicense your rights

7.3 User-Generated Content

Your Personal Data: You retain ownership of your personal vocabulary, notes, and learning progress. This data is stored locally on your device and is not transmitted to our servers except as specified in our Privacy Policy.

Feedback and Suggestions: Any feedback, suggestions, or ideas you provide to us become our property and may be used without compensation or attribution.

7.4 Third-Party Content

The Service may contain content licensed from third parties. Such content is protected by the respective owners' intellectual property rights and is used under appropriate licenses.

Content Creation: Our educational content, including but not limited to text, audio, and visual materials, is created using various tools and technologies available for commercial use under valid licenses. All content creation adheres to applicable licensing terms and intellectual property laws.

Compliance: We maintain appropriate licenses for all content creation tools and services used in developing educational materials. Users acknowledge that modern content creation may utilize various technologies and methodologies.

Third-Party Licenses: The Service incorporates various open-source libraries, icons, and assets under their respective licenses (MIT, Apache 2.0, etc.).

Complete Attribution: This application uses numerous open-source libraries, predominantly under MIT license, with others under ISC, BSD, Apache 2.0, and compatible licenses. A complete list of all third-party licenses and their copyright notices is available on our Licenses page.

License Compliance: We acknowledge and respect all copyright holders of the open-source libraries we use. All usage complies with the respective license terms including attribution requirements where specified.

7.5 DMCA Compliance

We respect intellectual property rights and respond to valid DMCA takedown notices. If you believe your copyrighted work has been used inappropriately, please contact us with:

  • Identification of the copyrighted work
  • Location of allegedly infringing material
  • Your contact information and electronic signature
  • Statement of good faith belief and accuracy

8. PRIVACY AND DATA PROTECTION

8.1 Privacy Commitment

Privacy-by-Design: Our Service is built with privacy as a fundamental principle. The vast majority of your data is processed and stored locally on your device.

8.2 Data Minimization

We collect and process only the minimum data necessary for Service functionality:

  • No Account Data: No registration, email, or personal identification required
  • Local Storage: Learning progress, vocabulary, and settings remain on your device
  • Limited Server Data: Only subscription status and optional support communications
  • Analytics Data: Anonymous usage analytics via Firebase Analytics (opt-out available in certain regions)
  • Crash Reports: Automatic crash reporting via Firebase Crashlytics for app stability (cannot be disabled)

8.3 Data Deletion Rights

Complete Control: You can permanently delete all your data by uninstalling the app. This removes all local data including learning progress, vocabulary, and settings.

No Recovery: After uninstallation, data cannot be recovered as it is not stored on our servers.

9. DISCLAIMERS AND WARRANTIES

9.1 Service Availability

"As Is" Service: The Service is provided "as is" and "as available" without warranties of any kind, either express or implied.

No Guarantees: We do not guarantee:

  • Continuous, uninterrupted, or error-free operation
  • Compatibility with all devices or operating systems
  • Achievement of specific learning outcomes
  • Accuracy of all educational content
  • Availability of third-party services (App Store, Google Play)

9.2 Educational Disclaimers

Learning Outcomes: While our Service is designed to facilitate German language learning, individual results may vary. We do not guarantee specific learning outcomes, fluency levels, or certification eligibility.

Professional Instruction: Our Service is a supplementary learning tool and does not replace formal language instruction or professional educational guidance.

9.3 Technical Disclaimers

Device Compatibility: Service functionality depends on device capabilities, operating system versions, and available storage space.

Internet Connectivity: Some features require internet connection for initial content download and subscription management.

10. LIMITATION OF LIABILITY

10.1 Exclusions

Maximum Legal Extent: To the fullest extent permitted by applicable law, we exclude all liability for:

  • Indirect Damages: Lost profits, data loss, business interruption
  • Consequential Damages: Any damages arising from use or inability to use the Service
  • Third-Party Services: Issues with App Store, Google Play, or advertising services
  • Device Damage: Hardware or software damage to your device
  • Data Loss: Loss of learning progress or personal data

10.2 Damage Cap

Liability Limit: Our total liability for any claims arising from or related to these Terms or the Service shall not exceed the greater of:

  • $100 USD, or
  • The amount you paid for Premium subscriptions in the 12 months preceding the claim

10.3 Essential Purpose

These limitations are fundamental elements of the agreement between us. The Service would not be provided without these limitations.

11. INDEMNIFICATION

Your Responsibility: You agree to indemnify, defend, and hold harmless the service provider and associated parties from any claims, damages, losses, or expenses (including legal fees) arising from:

  • Your violation of these Terms
  • Your misuse of the Service
  • Your violation of any law or third-party rights
  • Any content you submit or share through the Service

12. TERMINATION

12.1 Termination by You

Easy Termination: You may stop using the Service at any time by:

  • Uninstalling the mobile application
  • Canceling any active subscriptions through your device settings
  • Ceasing to access the website

12.2 Termination by Us

We may terminate or suspend your access to the Service immediately, without notice, for:

  • Violation of these Terms
  • Fraudulent activity or payment disputes
  • Abuse of promotional systems
  • Legal compliance requirements
  • Technical security concerns

12.3 Effects of Termination

Immediate Effect: Upon termination:

  • Your right to use the Service ceases immediately
  • Premium benefits are revoked (unless termination is wrongful)
  • Local data remains on your device until app uninstallation
  • Obligations under these Terms survive termination

13. FORCE MAJEURE

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to:

  • Natural disasters, pandemics, or government actions
  • Internet outages or telecommunications failures
  • Third-party service disruptions (App Store, Google Play, hosting providers)
  • Cyber attacks or security incidents
  • Changes in applicable laws or regulations

14. GOVERNING LAW AND JURISDICTION

14.1 Applicable Law

These Terms are governed by and construed in accordance with the laws of Germany, without regard to conflict of law principles.

14.2 Jurisdiction

Any disputes arising from or relating to these Terms or the Service shall be resolved in the competent courts of Berlin, Germany.

14.3 Consumer Rights

Nothing in these Terms affects your statutory rights as a consumer under applicable local law. If you are a consumer, you may have the right to bring proceedings in the courts of your country of residence.

15. CHANGES TO TERMS

15.1 Our Right to Modify

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting on our website or app.

15.2 Notification of Changes

Your Responsibility: You are responsible for regularly checking for updates to these Terms. Changes will be posted on our website: magellanister.netlify.app/terms

15.3 Acceptance of Changes

Continued Use: Your continued use of the Service after changes constitutes acceptance of the modified Terms.

Disagreement: If you disagree with changes, you must stop using the Service.

16. GENERAL PROVISIONS

16.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Service and supersede all prior agreements and understandings.

16.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

16.3 Waiver

Our failure to enforce any provision of these Terms shall not constitute a waiver of such provision or our right to enforce it in the future.

16.4 Assignment

You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights and obligations to any third party without restriction.

16.5 Third-Party Beneficiaries

These Terms do not create any third-party beneficiary rights except as explicitly stated.

17. APPLE-SPECIFIC TERMS FOR iOS USERS

The following terms apply specifically to users who download the Magellanister application from the Apple App Store. These terms are required by Apple and supplement the general Terms of Service above.

17.1 Acknowledgement

You and Magellanister acknowledge that these Terms of Service are concluded between you and Magellanister only, and not with Apple Inc. ("Apple"). Magellanister, not Apple, is solely responsible for the Magellanister application and its content. These Terms may not provide for usage rules that conflict with the Apple Media Services Terms and Conditions.

17.2 Scope of License

The license granted to you for the Magellanister application is limited to a non-transferable license to use the application on any Apple-branded products that you own or control and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions. The application may be accessed and used by other accounts associated with the purchaser via Family Sharing or volume purchasing.

17.3 Maintenance and Support

Magellanister is solely responsible for providing any maintenance and support services with respect to the application, as specified in these Terms or as required under applicable law. You and Magellanister acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the application.

17.4 Warranty

Magellanister is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the application to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the application to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the application, and any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty will be Magellanister's sole responsibility.

17.5 Product Claims

You and Magellanister acknowledge that Magellanister, not Apple, is responsible for addressing any claims of yours or any third party relating to the application or your possession and/or use of the application, including, but not limited to: (i) product liability claims; (ii) any claim that the application fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation. These Terms do not limit Magellanister's liability to you beyond what is permitted by applicable law.

17.6 Intellectual Property Rights

You and Magellanister acknowledge that, in the event of any third party claim that the application or your possession and use of the application infringes that third party's intellectual property rights, Magellanister, not Apple, will be solely responsible for the investigation, defense, settlement and discharge of any such intellectual property infringement claim.

You represent and warrant that: (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

17.8 Third Party Terms of Agreement

When using the Magellanister application, you must comply with applicable third party terms of agreement. For example, if you have a VoIP application, you must not be in violation of your wireless data service agreement when using the application.

17.9 Third Party Beneficiary

You and Magellanister acknowledge and agree that Apple, and Apple's subsidiaries, are third party beneficiaries of these Terms, and that, upon your acceptance of the terms and conditions of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third party beneficiary thereof.
